While we can connect you with REPs, we do not enroll you directly - you'll complete your enrollment with your chosen provider.

1. Services Overview

1.1 What We Do

Power My Society, a Delaware corporation ("us," or "our") operates www.powermy.casa (the "Website"), an online platform that allows users to compare electricity plans from various retail electric providers in Texas. We are registered as a broker (Registration #BR240245) with the Public Utility Commission of Texas. We operate under the registered names Power My Society, Power My Casa, and Power My Business.

Our platform uses artificial intelligence and automated systems to analyze your usage patterns and recommend plans. While we strive for accuracy, these are estimates based on historical data and algorithms.

1.2 Service Duration, Future Services, and Agent Authorization

Our plan comparison and referral services are provided on a per-transaction basis. You may use our services at any time without ongoing obligation.

While we currently direct you to retail electric providers to complete enrollment independently, we may in the future offer direct enrollment services. If we do so, we will obtain your explicit written authorization to act as your agent for enrollment purposes, as permitted under Texas regulations. Any such agency relationship would be clearly disclosed and limited to the specific enrollment transaction you authorize.

1.3 What We Don't Do

  • We do not currently act as your agent (though we may offer this service in the future as described in Section 1.2)
  • We do not enroll you directly with retail electric providers
  • We do not manage your electricity account
  • We do not guarantee the accuracy of prices or terms shown by providers

2. Fees and Compensation

2.1 Platform Fees

Our basic plan comparison service is free to use. We may charge fees for premium services such as renewal notifications or personalized consultations. When applicable, all fees will be clearly disclosed before you use these services.

2.2 Provider Compensation

We may receive compensation from retail electric providers when you enroll in their services through our platform. This compensation is typically in the form of a commission paid by the provider and is built into their rates. We show you a broad range of available plans from our system that match your criteria, including ones we don't get paid for, to help you find the best option.

We receive compensation from some but not all providers shown. For details about our compensation arrangements as required by Texas regulations, see our Regulatory Disclosures page.

3. User Accounts and Communications

3.1 Optional Account Creation

You may create an account to receive renewal notifications and personalized plan recommendations. Account creation is not required to use our basic comparison tools.

3.2 Email Communications

If you create an account, we will send you:

  • Renewal reminders
  • Plan recommendations
  • Service updates

You may opt out of these communications at any time.

3.3 Data Retention

Your uploaded bill file is deleted within 24 hours. We retain extracted data and service records for a minimum of 4 years to comply with our business agreements and regulatory requirements. Texas regulations require minimum 2-year retention, but we maintain records longer to ensure complete compliance with all our obligations. By using our service, you consent to this data retention.

4. Your Responsibilities

4.1 Accurate Information

You agree to provide accurate information when using our services or creating an account.

4.2 Account Security

If you create an account, you are responsible for maintaining the confidentiality of your account credentials.

5. Privacy and Data Protection

5.1 Information Collection

We collect and use your information as described in our Privacy Policy, available at www.powermy.casa/privacy-policy.

5.2 Information Sharing

We will not share your proprietary information with any third party unless:

  • You provide written authorization
  • Disclosure is required by law
  • Disclosure is to the Public Utility Commission of Texas

We share information with service providers who help operate our platform, including:

  • Cloud hosting and data storage providers
  • Analytics and monitoring services
  • AI model providers for usage analysis

All service providers are bound by confidentiality obligations and may only use your information to provide services to us.

6. Disclaimer of Warranties

6.1 Service Accuracy

While we strive to provide accurate information, we cannot guarantee that all prices, terms, and conditions shown on our Website are current or error-free. Plan information is updated regularly but may not reflect real-time changes. You should verify all information with your chosen retail electric provider before enrollment.

Prices and availability may change between the time you view a plan and when you attempt to enroll.

6.2 Service Availability

Our Website is provided "as is" and "as available." We do not warrant that the Website will be uninterrupted or error-free.

7. Limitation of Liability

7.1 Service Usage

We are not liable for any damages arising from:

  • Your use of our Website
  • Decisions made based on information provided through our Website
  • Any unauthorized access to your account
  • Errors or omissions in the information provided

7.2 Provider Services

We are not responsible for the services provided by retail electric providers. Any disputes regarding electricity service should be directed to your chosen provider.

7.3 Damage Limitations

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST SAVINGS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Changes to Terms

We may update these Terms of Service periodically. We will notify users of material changes through our Website or by email if you have an account with us.

9.2 Complaint Resolution

9.4 Alternative Dispute Resolution

For residential and small commercial customers, we will not require submission of complaints to arbitration or mediation by third parties. Your right to file a formal or informal complaint with the commission cannot be restricted by any written or verbal agreement.

10. Governing Law and Jurisdiction

10.1 Corporate Matters

For matters relating to corporate governance and interpretation of these Terms of Service, the laws of the State of Delaware shall govern, without regard to principles of conflicts of law.

10.2 Service Regulation

For matters relating to electricity broker services and utility regulations, these Terms of Service are governed by applicable Texas law and regulations, including but not limited to the rules of the Public Utility Commission of Texas.

10.3 Jurisdiction for Disputes

Disputes will be resolved in the following courts:

  • Electricity service disputes: Texas courts
  • All other disputes: Delaware courts

By using our services, you consent to the jurisdiction of these courts.

10.4 Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole.

11. Additional Terms

11.1 Minimum Age

You must be at least 18 years old to use our services, as electricity service agreements are legal contracts.

11.2 Service Area

Our services are only available for properties with Texas electricity service addresses. We do not provide services for properties outside of Texas.

11.3 User Feedback and Ideas

Any feedback, suggestions, or ideas you provide about our services become our property. We may use these without compensation to you for any purpose, including improving our services or creating new features.

11.4 Class Action Waiver

You agree to resolve disputes with us individually and waive any right to participate in class action lawsuits against us.

11.5 Electronic Communications

By providing your email address, you consent to receive transactional emails about your service usage. Marketing emails require separate opt-in consent.

11.6 No Guarantee of Savings

While we show potential savings based on your historical usage, actual savings depend on future usage patterns, weather, and other factors beyond our control. Past usage does not guarantee future consumption patterns.

11.7 Arbitration for Non-Regulatory Disputes

For disputes not related to Texas electricity regulations or PUCT matters, you agree to attempt resolution through binding arbitration before pursuing litigation. This does not limit your right to file complaints with regulatory agencies.

11.8 Right to Refuse Service

We reserve the right to refuse or terminate service to any user who violates these Terms, engages in fraudulent activity, or uses our services in a manner we deem abusive or harmful to our operations or other users.

11.9 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without liability to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Power My Society and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any rights of another; or (d) any information you provide to us.

13. Intellectual Property

All content on our Website, including text, graphics, logos, and software, is our property or that of our licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our content without written permission.

14. Entire Agreement

These Terms, together with our Privacy Policy and Regulatory Disclosures, constitute the entire agreement between you and Power My Society regarding our services and supersede all prior agreements and understandings.
